BAC/BIAC Revises 12th Arbitration Rules: Welcome Global Feedback

Dear arbitration professionals and participants,

Since its establishment, Beijing Arbitration Commission/Beijing International Arbitration Court (BAC/BIAC) has been committed to providing independent, impartial, professional, efficient and excellent arbitration services. In order to better address the evolving demands of commercial arbitration and further refine the scientific, rational and practical aspects of its Arbitration Rules, the BAC/BIAC is pleased to announce the commencement of the revision process for the Arbitration Rules. We are now inviting feedback from legal professionals and arbitration participants worldwide.

I. History of Revisions

The BAC/BIAC has consistently pursued innovation in its Arbitration Rules by integrating Chinese arbitration practices with global standards. Through the adoption of widely accepted international practices, the BAC/BIAC has established itself as a key player in dispute resolution, institutional governance, and industry development in China. Since its founding, the BAC/BIAC has issued and updated its Arbitration Rules in eleven editions (historical versions can be viewed at: https://www.bjac.org.cn/english/page/zc/guifan2019.html), ensuring flexible and accessible arbitration services for both domestic and international parties.

II. Consultation

The BAC/BIAC welcomes opinions and suggestions from a wide range of sectors globally to better understand the needs of parties from different industries and regions. By integrating advanced international arbitration principles and practical insights, we aim to further improve our arbitration rules framework. This initiative is intended to address the evolving demands of global arbitration practices, ensuring that the revised Arbitration Rules are more forward-looking, inclusive, and practical, and ultimately elevating the quality of the BAC/BIAC’s arbitration services and institutional strength.

III. Responses

First Round of Online Survey

We invite you to participate in a brief survey to share your valuable suggestions and insights. Your expertise and unique perspectives in arbitration are crucial to helping us optimize our arbitration processes and improve service quality. This survey consists of 6 questions and is estimated to take approximately 5 minutes to complete. Please submit your responses by March 24, 2025.

You can also submit your comments and suggestions in the following ways:

1. E-mail: Please send your comments and suggestions to the BAC/BIAC at bjzhongcai@bjac.org.cn. In the subject line of your email, please indicate “Suggestions on Revision Arbitration Rules”, include your professional affiliation (eg. arbitrator, lawyer, corporate counsel, academic, etc.) along with your contact information for further communication. 

2. Written Mail: You may also mail your written comments and suggestions to: 16/F, China Merchants Building, No.118 Jianguo Road, Chaoyang District, Beijing, and indicate “For Soliciting Opinions on Revision to Arbitration Rules” on the envelope. 

The BAC/BIAC will form a dedicated team to systematically collect, review, and analyze the feedback received, and will engage experts from relevant fields for detailed discussions and evaluations. Updates on the revision progress, interim findings, and the final version will be shared publicly through the BAC/BIAC official WeChat account, website, and other public platforms. 

Following the conclusion of the public consultation, the BAC/BIAC will continue with a series of research activities focusing on specific areas of the arbitration rules. We invite you to stay informed and engaged for further updates!
